Thanks for such an elaborated response! It is universally accepted principle of Islamic Law that strict punishments require strict evidence. It is evident from the article that Blasphemy is punished with death and there is no exception to it. It is unpardonable and can be executed extra-judicially. There is absolutely no doubt in it. However, Shah Jee did not mention any criteria for testing the evidence. If someone claims that a person is guilty of Blasphemy, what is the level of evidence that is required? Or it does not need evidence? Benefit of Doubt will go to the accused or accuser? For extra-Judicial Murder what the executer (Like Mumtaz Qadri) must analyze before executing the accused? What is the logic of 295-C if everyone is to execute the accused? What is the punishment of a person who wrongly files a petition against a person for Blasphemy? If a court in Pakistan grants acquittal to a person guilty of Blasphemy, should Ushaqan-e-Rasool execute themselves?
If someone says, ” 295-C IS SUBSTANTIALLY ACCORDING TO QURAN AND SUNNAH. THE BLASPHEMER HAS NO PARDON. HE MUST BE AWARDED CAPITAL PUNISHMENT. BUT, PROCEDURAL ASPECTS OF THE LAW CAN BE REVISED. HE IS OF THE VIEW THAT SPECIAL CARE AND PROCEDURES MUST BE ADOPTED/CARRIED ON FROM THE LODGMENT OF FIR TO THE EXECUTION THAT THERE IS NOT A MILDEST DOUBT IN FAIR TRIAL. THIS IS BECAUSE OF THE FACT THAT CAPITAL PUNISHMENT IN THE NAME OF RAHMAT FOR ALL THE WORLDS BE BASED ON STRICTLY PRUDENT AND BASED ON PRINCIPLES OF EQUITY AND JUSTICE. HE IS OF THE VIEW THAT IF PROVED WRONG, THE ACCUSER MUST BE EXECUTED TO DEATH IN THE SAME COURT SESSION WITH RIGHT TO APPEAL IN THE HIGHER COURT. IF A COURT GRANTS ACQUITTAL, USHAQ MUST ALSO ACCEPT IT. WHAT IS THE ISLAMIC DECREE ABOUT THE PERSON HAVING ABOVE VIEWS?
